EPA Finalizes Endangerment Finding for Greenhouse Gases

On December 7, 2009, EPA finalized its endangerment finding, which found that the 6 major greenhouse gases endanger the public’s health and welfare.  (The final findings were published in the Federal Register on December 15, and the final rule will be effective January 14, 2010.)  This action was a legal prerequisite to finalizing the EPA’s proposed greenhouse gas emission standards for light-duty vehicles (see below.)  That rule, in turn, (when finalized) would regulate greenhouse gases under the Clean Air Act (CAA) for the first time, and open the door for EPA to regulate greenhouse gases under the CAA in other industry sectors as well.
