New Greenhouse Gas Reporting Rule Proposal

On July 7, EPA published a proposed rule linked to its GHG Reporting rule in the Federal Register.  The proposal, which can be found at , seeks to determine the confidentiality status of data required to be reported under the Reporting rule.  The new proposal “describes the data categories EPA has developed for” the Reporting Rule’s data elements “and EPA’s proposed confidentiality determination for each category.”  Additionally, the proposed rule includes a proposed amendment which would “authorize EPA to release or withhold as confidential reporting elements” in the Reporting Rule “according to the determinations made in a final action without taking certain additional procedural steps currently required.”  And the proposed rule solicits comments on several issues related to the confidentiality determinations and the amendment.
