Court Order Leaves Definition of Solid Waste Settlement Agreement In Effect

Yesterday, on January 11, a U.S federal court issued an order concerning the Definition of Solid Waste (DSW) litigation.  Among other provisions,  the Settlement Agreement filed by Sierra Club and EPA in September remains in effect and obligates EPA to propose a new DSW rule in June, and issue a notice of final administrative action by December 31, 2012.  Both EPA and The Sierra Club are required by the court to file 90-day status reports and to file motions to govern further proceedings within 30 days of the final administrative action.  In the meantime, it is also important to remember that the final DSW rule remains in effect, and the litigation is stayed for the next two years.
