Judge Rejects EPA’s Longer Boiler Rule Extension Request; Final Boiler Rules now Mandated by February 21

The Federal Judge ruling on EPA’s request for an extension for the boiler MACT and related rules has rejected EPA’s requests for an extension into April 2012, or failing that, its shorter proposed extension to June 2011.  Instead, the judge has granted the agency one additional month – until February 21, 2011 – to issue the final Boiler rules. 

In response to the court’s ruling, EPA noted that it “will work diligently to issue these standards by this new deadline,” but also added that it “believes these changes still deserve further public review and comment and expects to solicit further comment through a reconsideration of the rules. Through the reconsideration process, EPA intends to ensure that the rules will be practical to implement … “  Additionally, “The agency is considering all other options for addressing these issues before the rules would become effective 60 days after publication in the Federal Register.”
