Industry Coalition files Petition for Review, and Request for Administrative Stay, of Boiler MACT rule

On April 29, an industry coalition consisting of over 15 trade associations, including the Society of Chemical Manufacturers and Affiliates and the American Chemistry Council, filed a petition for review of the Boiler MACT with a federal court of appeals. This filing followed the coalition’s April 27 submission of a request for an administrative stay of the Boiler MACT rule. In its petition for an administrative stay, the coalition cited the fact that its members would suffer irreparable harm if the stay wasn’t granted. Additionally, the group noted EPA’s own decision to reconsider major elements of the boiler rules, and argued that this reconsideration notice did not include some issues which also needed to be revisited. Barring a stay, the Boiler MACT and area sources rule (and the two other rules included in the original package of four) go into effect on May 20.
