EPA Releases Spring Regulatory Agenda

On May 23, EPA released its Spring 2014 Regulatory Agenda.  (These agendas list the regulatory items on the Agency’s agenda for both the near and long-term, and give updated forecasts for the timing of the next expected action on a given issue.)

Items of interest to the chemical industry included:
  • The Definition of Solid Waste (DSW) rule  – a final rule is now expected in July;
  • A reconsidered Boiler MACT rule – a proposed rule is expected in July, with a final rule expected in February 2015;
    • On August 5, 2013, EPA granted reconsideration on three issues raised in various petitions for reconsideration.  The proposed rule will solicit public comment on the three issues, and announce amendments to clarify implementation issues raised by stakeholders and to make technical corrections.
  • A reconsidered Boiler Area Sources rule --  a proposed rule expected in July, with a final rule expected in February 2015;
    • Similarly, on  August 5, EPA granted reconsideration on five issues raised in various Boiler GACT petitions for reconsideration. The proposed rule will solicit public comment on the five issues, and announce amendments to clarify implementation issues raised by stakeholders and to make technical corrections.

Additionally, final action on EPA’s proposed National Uniform Standards for Storage Vessel and Transfer Operations, Equipment Leaks, Closed Vent Systems and Control Devices; Revisions to the National Uniform Emission Standards General Provisions remains delayed indefinitely or, as EPA put it, “to be determined.” 

Other issues of note included:

  • Definition of "Waters of the United States" Under the Clean Water Act  -- final rule is expected by April 2015, although I suspect that this may be delayed given how much controversy the proposal has stirred up.
  • Review of the National Ambient Air Quality Standards (NAAQS) for Ozone – proposed rule expected December
  • Water Quality Standards Regulatory Revisions – final rule expected May 2015
