The final EHS&S Regulatory Webinar of 2013 will discuss recent legal rulings concerning significant PSM enforcement issues. These issues include: PSV’s and the 3% inlet pressure drop, acceptable interim measures to address deficiencies in process equipment, the appropriate amount time to address PHA recommendations for facility siting, OSHA’s use of a voluntary  audit as a road map to target violations, and employee misconduct by a supervisor.

The presentation will also address several recent regulatory issues, such as: the proposed electronic reporting of injuries and illnesses, the calculation of threshold quantities for mixtures, the use of union officials to help OSHA inspect non-union shops, and rate based safety incentive programs and employee discipline as violations of the OSH Act.

About the speaker:

Mark Dreux, is the head of the OSHA Group in Arent Fox’s Labor & Employment Practice and is nationally recognized for his work in occupational safety and health law. Mark focuses on representing employers and trade associations in all aspects of the Occupational Safety and Health Act (OSH Act). Over the last 20 years, Mark has defended employers in 30 fire and explosion incidents, 105 fatality investigations, and hundreds of citations alleging violations of the general duty clause and OSHA standards. From 1984 to 1987, Mark was a federal prosecutor, and he frequently combines his extensive knowledge of criminal and OSHA law to defend employers in criminal OSHA proceedings.

Valerie Butera is an associate at Arent Fox, Practice Areas who focuses exclusively on complex OSHA litigation matters. She is OSHA 30 certified and has substantial training and experience in process safety management (PSM).  Her recent client work includes:

  • Assisting in the representation of petrochemical companies in response to OSHA’s Petroleum Refinery PSM National Emphasis Program and alleged violations of the hazardous communication standard
  • Acting as lead associate for employers defending a variety of OSHA citations alleging violations of OSHA’s General Industry and Construction standards
  • Drafting the official response of several trade associations to the Chemical Safety Board’s 2012–2016 Strategic Plan
